We are registered in the Federal Republic of Nigeria with the registration number 1512956 and have our registered office at 54, Lobito Crescent, Wuse 2, Abuja; and in The State of Delaware, United States of America with mailing address as The Green, Ste A, Dover, Delaware.

Services we make available to you:

  • MISSING VEHICLES REPORTING

    You may access and use our website for the reporting of actionable data of stolen or missing vehicles. You may access the site and fill in forms wherein you shall provide us with your contact details, any required information and details of the vehicle to enable us upload same in our database while making same available to third parties.

    You authorize LegitCar to do any and all that is necessary for provision of its services to you, provided we are in compliance with laws and regulations governing the provision of our services. Once you verify and upload the User Data and/or other documents and details in the electronic form, we shall process the same. Upon the completion of the User Data verification by us, our services may be sanctioned by LegitCar to you, subject to fitting eligibility criteria and other conditions set forth by LegitCar.

    LegitCar reserves the right to amend the fees payable for the Services offered on the site. LegitCar agrees to publish fee changes on the website at least four weeks in advance or notify you of a fee change by email.

  • STOLEN VEHICLES CHECK AND VEHICLE HISTORY REPORTS

    Through the Services, you may facilitate a due diligence on ownership and status of vehicles advertised or put up for sale by accessing and using our database on the site containing about 2,000 (Two Thousand) actionable data of stolen or missing vehicles, and data on the registered vehicles in the country. You may also access and use our website for the reporting of actionable data of stolen or missing vehicles. We also provide Carfax, ClearVin, and VinDocs Vehicle History Reports which chronicles a vehicle's life history before it was shipped to Nigeria.

    To use the service, you may access the website and fill in forms wherein you shall provide us with your contact details, any required information and details of the vehicle to enable us conduct a search in our database. We may also conduct searches on third-party websites in providing the service. In order to avail the Services, you are required to register with LegitCar by visiting the website. As part of the services, you authorize us to import your details and personal information dispersed over third-party sites. You understand and acknowledge that we may periodically request for updates on such personal information, and we may receive such updated information from third party websites.

    You authorize LegitCar to do any and all that is necessary for provision of its services to you, provided we are in compliance with laws and regulations governing the provision of our services. Once you verify and upload the User Data and/or other documents and details in the electronic form, we shall process the same. Upon the completion of the User Data verification by us, our services may be sanctioned by LegitCar to you, subject to fitting eligibility criteria and other conditions set forth by LegitCar.

    To use this service, you are required to pay the sum of N3,000 (Three Thousand Naira Only) for which the stolen status check and ownership verification is done, unless the Company and you have agreed otherwise or on a different fee .

  • PRE-PURCHASE INSPECTION SERVICE

    Through our service, we will conduct a physical inspection of vehicles for users before they make payment. We use our state-of-the-art On-Board Diagnostic Devices (“OBD") to check the general health condition of the vehicles; and additionally, we provide a Carfax Vehicle History Report or any other relevant Vehicle History Report, and also the Inspection Report after such checks and investigations. The Service also involves a stolen status check and ownership verification for registered vehicles.

    To use the service, you may access the site and fill in forms wherein you shall provide us with your contact details, any required information and details of the vehicle. In order to avail the Services, you are required to register with LegitCar by visiting the site. As part of the services, you authorize us to import your details and personal information dispersed over third-party sites.     To use this service, you are required to pay the sum of N20,000 (Twenty Thousand Naira Only) per vehicle, unless the Company and you have agreed otherwise or on a different fee .

We may make changes to these terms

We amend these terms from time to time. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply at that time.

We may make changes to our site

We may update and change our website from time to time to reflect changes to our products, our users' needs, and our business priorities. We will try to give you reasonable notice of any major changes.

We may suspend or withdraw our website

Our website is made available free of charge.

We do not guarantee that our website, this service or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our website and our service for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

You are also responsible for ensuring that all persons who access our website or our service through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

We may transfer this agreement to someone else

We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

You must keep your account details safe

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at info@legitcar.ng.

How you may use material on our website

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged (except where the content is user-generated).

You must not use any part of the content on our site for commercial purposes without obtaining a license to do so from us or our licensors.

If you print off, copy, download, share or repost any part of our website in breach of these terms of use, your right to use our website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

No text or data mining, or web scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our website or any services provided via, or in relation to, our site. This includes using (or permitting, authorising or attempting the use of):

  • Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the website or any data, content, information or services accessed via the same.

  • Any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations.

The provisions in this clause should be treated as an express reservation of our rights in this regard.

This clause shall not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

Our responsibility for loss or damage suffered by you

  • We exclude all implied conditions, warranties, representations or other terms that may apply to our website or any content on it.
  • We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
    • use of, or inability to use, our website; or
  • In particular, we will not be liable for:
    • loss of profits, sales, business, or revenue;
    • business interruption;
    • loss of anticipated savings;
    • loss of business opportunity, goodwill or reputation; or
    • any indirect or consequential loss or damage.

Uploading content to our website

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out herein.

We have the right to remove any posting you make on our website if, in our opinion, your post does not comply with our content standards.

Rights you are giving us to use material you upload

When you upload or post content to our site, you grant us the following rights to use that content:

  • a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by the website and across different media, including to promote the site or the service forever;

We are not responsible for viruses and you must not introduce them

We do not guarantee that our website will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and site to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Limitation of liability

You expressly understand and agree that LegitCar, including its directors, officers, employees, representatives or the service provider, shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if LegitCar has been advised of the possibility of such damages), resulting from; (a) use or the inability to avail the site; (b) inability to use the site; (c) failure or delay in accessing the site (d) any performance or non-performance by LegitCar (e) any damages to or viruses that may infect your electronic devices or other property as the result of your access to the site or your downloading of any content from the site and (f) server failure or otherwise or in any way relating to the site.

We do not warrant that the information obtained through the use of our site with respect to the services is true, correct, and conclusive. We do not warrant that the information communicated via the vehicle history report is true, correct and conclusive of the status and history of the vehicle at the date of such report.

LegitCar and our services shall not be considered advisors or advisory services with respect to the purchase, search, or the conduction of any due diligence whatsoever of any vehicle.

You hereby acknowledge that the use of our services does not imply the guilt or liability of any third-party with respect to the status of any vehicle. Should you have reasons to believe that a vehicle is a stolen vehicle or in any way connected to an offence in relation to obtaining or using the vehicle, you hereby undertake to take legal steps in addressing such issues. LegitCar shall not be made a party to any suit or investigation in relation to the theft-status of the vehicle, and where this is unavoidably the case, you shall indemnify us of the cost of representation (including legal representation).

You agree to indemnify and hold LegitCar, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising out of (i) your violation of these Terms; (ii) your violation of any rights of other users of the site; (iii) your use or misuse of the site; and/or (iv) your violation of applicable laws.

You understand and acknowledge that you shall be solely responsible for all the activities that occur under your User Account while availing the site. You undertake that LegitCar shall not be responsible and liable for any claims, damages, disputes arising out of use or misuse of the site. By usage of the site, you shall be solely responsible for maintaining the confidentiality of the User Account and for all other related activities under your User Account. LegitCar reserves the right to accept or reject your registration for the service without obligation of explanation.

Which country's laws apply to any disputes?

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by the laws of the Federal Republic of Nigeria. You and we both agree that the courts of the Federal Republic of Nigeria will have exclusive jurisdiction.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by the laws of the Federal Republic of Nigeria. We both agree to the exclusive jurisdiction of the courts of the Federal Republic of Nigeria.
